  3. Contractual relations are governed primarily by Act No. 89/2012 Coll., the Czech Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended.

  4. These Terms apply to sales of goods. Voluntary financial donations made to the association without any entitlement to goods or other consideration are not purchases and are subject to applicable legislation and any separate donation conditions.

II. Products and Prices

  1. The Seller offers products associated with the activities of the association, including promotional merchandise and other goods.

  2. Product descriptions, specifications, availability and prices are displayed on the online store.

  3. Prices are stated in Czech koruna (CZK), unless another currency is expressly indicated. Prices are final and include any applicable taxes and mandatory charges.

  4. Delivery costs are displayed separately during checkout unless expressly included in the product price.

  5. Before submitting a binding order, the Buyer is informed of the total purchase price, including all applicable delivery charges.

  6. The Seller reserves the right to change product prices and availability. Changes do not affect purchase contracts already concluded.

III. Orders and Contract Formation

  1. The Buyer selects products, places them in the shopping cart and provides the information necessary to process the order.

  2. Before submitting an order, the Buyer may review and correct the entered information, choose a payment and delivery method and verify the total amount payable.

  3. The order is submitted by means of a button that clearly indicates the obligation to pay, such as "Order with obligation to pay".

  4. By submitting an order, the Buyer makes a binding offer to conclude a purchase contract.

  5. The purchase contract is concluded when the Seller confirms acceptance of the order by email. The Seller provides confirmation of the contract and the applicable Terms on a durable medium.

  6. The contract is concluded in the language selected in the online store, provided that the Seller offers checkout in that language.

  7. The Buyer's costs of using means of distance communication do not exceed the standard rates charged by their service provider.

  8. The Seller may decline an offer to conclude a contract where the goods are objectively unavailable or other lawful reasons apply. If a contract has already been concluded, any change or cancellation is governed by applicable law.

IV. Payment Terms

  1. The available payment method is:

Bank transfer to the Seller's bank account.

  1. After placing an order, the Buyer receives payment instructions including the bank account number, total amount payable and the payment reference or order identification.

  2. The Seller may also provide a QR code to facilitate payment.

  3. Payment must be completed within the period specified in the payment instructions.

  4. Payment is considered received when the full amount is credited to the Seller's bank account.

  5. Goods are generally dispatched or prepared for personal collection only after full payment has been received.

  6. If the Buyer fails to pay within the specified period, the Seller may request payment within an additional reasonable period. If payment is still not received, the Seller may exercise the rights available under the Czech Civil Code.

  7. Proof of purchase will be provided in accordance with applicable law.

V. Shipping and Delivery

  1. The Seller offers the following delivery methods:

a) PPL – Home Delivery

Goods are delivered by PPL to the delivery address specified in the order.

b) PPL – Pickup Point

Goods are delivered to an available PPL pickup point or parcel locker selected by the Buyer. Information about collection is provided through the carrier's communication channels.

c) Personal Collection

The Buyer may personally collect the goods at a location designated by the Seller. The exact address and collection arrangements will be communicated during checkout or in subsequent instructions from the Seller.

  1. Shipping charges are displayed during checkout before the order is submitted.

  2. The availability of delivery options may depend on the nature of the goods, the delivery destination and carrier services.

  3. Unless a different delivery period has been agreed, the Seller will deliver the goods without undue delay and no later than 30 days after conclusion of the contract.

  4. If the Seller delays delivery, the Buyer has the rights provided by the Czech Civil Code.

  5. The risk of loss or damage generally passes to a Consumer when the goods are received by the Consumer or a person designated by them other than the carrier, subject to statutory exceptions.

  6. Buyers are encouraged to inspect the condition of the parcel upon receipt and document any visible damage. Failure to inspect or report damage immediately does not limit statutory rights.

  7. Failure to collect a parcel does not automatically constitute withdrawal from the purchase contract. Such situations are governed by applicable law.

VI. Right of Withdrawal Within 14 Days

  1. A Consumer who purchases goods through the online store has the right to withdraw from the purchase contract without giving any reason within 14 days of receiving the goods.

  2. If several goods in one order are delivered separately, the withdrawal period generally starts upon receipt of the final item.

  3. A Consumer may also withdraw before receiving the goods.

  4. The Consumer may exercise the right of withdrawal by sending a clear statement:

  1. The model withdrawal form attached to these Terms may be used but is not mandatory.

  2. The withdrawal deadline is met if the Consumer sends the withdrawal notice before the deadline expires.

  3. The Consumer must return or hand over the goods within 14 days of notifying the Seller of withdrawal. Goods may be returned to the Seller's registered office or another address agreed with the Seller.

  4. The Consumer bears the direct costs of returning the goods.

  5. The Seller will reimburse the Consumer for payments received, including original delivery costs up to the least expensive standard delivery method offered by the Seller. Personal collection is disregarded when determining this amount.

  6. Reimbursement will be made within 14 days of receiving the withdrawal notice. However, the Seller may withhold reimbursement until the goods are received or the Consumer provides evidence of having returned them, whichever occurs first.

  7. Reimbursement will be made using the same payment method as the original transaction unless otherwise agreed, without additional costs to the Consumer.

  8. The Consumer is liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

  9. The statutory right of withdrawal does not apply to contracts covered by the exceptions specified in Section 1837 of the Czech Civil Code, including goods genuinely made to the Consumer's specifications or personalised for their individual needs.

  10. The statutory right of withdrawal also applies to eligible goods ordered online and subsequently collected in person.

VII. Defective Goods and Complaints

  1. The Seller is responsible for ensuring that the goods conform to the agreed description, quantity, quality and other characteristics, as well as applicable statutory requirements, upon delivery.

  2. Consumers may exercise their statutory rights in respect of defects that become apparent within two years of receiving the goods.

  3. If a defect becomes apparent within the first year after receipt, it is presumed to have existed at the time of delivery unless this is incompatible with the nature of the goods or defect.

  4. Buyers have the rights arising from defective performance as provided by the Czech Civil Code.

  5. Under the conditions established by law, a Consumer may request that a defect be remedied by repair or replacement, unless the chosen remedy is impossible or disproportionately expensive compared with the alternative.

  6. In cases specified by law, a Consumer may request a proportionate price reduction or withdraw from the purchase contract.

  7. Complaints may be submitted to:

Email: info@mestskeholubniky.cz

Telephone: +420 737 716 512

  1. Buyers are encouraged to provide the order number, a description of the defect, contact details and preferred remedy. Photographic evidence may assist the process but is not a general condition for accepting a complaint.

  2. The Seller will issue a confirmation of the complaint containing the information required by law. Following resolution, the Seller will provide confirmation of the outcome and date or written reasons for rejection.

  3. Consumer complaints, including the remedy of defects, must be resolved and the Consumer informed within 30 days of submission unless a longer period has been expressly agreed.

  4. The Consumer must provide reasonable cooperation necessary to assess the claimed defect.

  5. If the statutory or agreed deadline expires without resolution, the Consumer may request an appropriate price reduction or withdraw from the contract.

  6. In the case of a justified complaint, the Consumer is entitled to reimbursement of reasonably incurred costs associated with exercising their rights, in accordance with applicable law.

  7. Statutory rights relating to defective goods are independent of the right of withdrawal without giving a reason.

VIII. Personal Data Protection

  1. The Seller processes Buyers' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Czech legislation.

  2. Personal data is processed primarily to handle orders, perform purchase contracts, deliver goods, maintain accounting records and comply with legal obligations.

  3. Personal data necessary for delivery may be shared with PPL.

  4. Detailed information about the processing of personal data, legal grounds, retention periods and data subject rights is available in the separate Privacy Policy published on the Seller's website.

  5. Marketing communications are sent only in accordance with applicable law. Buyers may object to or unsubscribe from further marketing communications in the manner provided by law.

IX. Alternative Dispute Resolution

  1. If a consumer dispute arising from a purchase contract cannot be resolved amicably between the Seller and Consumer, the Consumer may submit a request for alternative dispute resolution.

  2. The competent authority is:

  2. For order enquiries, returns, complaints and other matters, customers may contact:

Telephone: +420 737 716 512

  1. The Buyer is responsible for providing accurate contact and delivery information in the order.

  2. The Seller handles enquiries and complaints without undue delay.

XI. Final Provisions

  1. These Terms form an integral part of the purchase contract between the Seller and the Buyer.

  2. Contractual relations are governed by Czech law. This does not affect mandatory consumer protection provisions applicable under the relevant conflict-of-law rules.

  3. If any provision of these Terms is invalid or unenforceable, the remaining provisions shall remain valid.

  4. The Seller may amend these Terms. The version effective at the time of conclusion of a particular purchase contract applies to that contract.

  5. These Terms are published in Czech, English and Spanish. All language versions are intended to express the same rights and obligations. In the event of interpretation differences, the Czech text serves as the reference version without limiting mandatory consumer rights.
